SUBSCRIPTION PLAN

This agreement (hereinafter also referred to as &nbsp;the Subscription Plan) was concluded by and between:

ABERG CONNECT limited liability company based in Wielun (98-300), F. Rymarkiewicz 6, NIP: 832 20 90 071, for which the District Court for Łódź Śródmieście in Łódź, XX Commercial Division of the National Court Register maintains registration files in the Register of Entrepreneurs under KRS 0000945986 (hereinafter referred to as &nbsp;the Service Provider) and
&nbsp;
Service recipient,

individually referred to as the Site, and collectively the Parties.

The Service User is entitled to use the ATP Portal on the basis of the ATP Portal Terms and Conditions and in accordance with this Agreement.
The Terms and Conditions of the ATP Portal can be found on the website at: <a href="https://files.abergtelematics.com/TermsOfServices-pl.pdf">https://files.abergtelematics.com/TermsOfServices-pl.pdf</a>.
By signing this Agreement, the Service User confirms that they had the opportunity to download the ATP Portal Terms and Conditions and that they agree to their provisions.

Terms of support

Complaints and comments concerning both the technical aspects of the functioning of the ATP Portal and other issues related to the Portal may be submitted by the Service User via the contact form on the ATP Portal. <h1>III.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Duration of the Subscription Plan</h1>

The Subscription Plan comes into force at the moment of collection by the Service User of the purchased vehicle equipped with the Telematics Device. Vehicles are usually assigned to the Company Account on the ATP Portal within 14 days from the moment of collection of the vehicle by the Service User.

Processing of personal data by the Parties
&nbsp;

1.&nbsp;&nbsp;&nbsp;&nbsp; The Service Provider will process the personal data of the Service Recipient and the Service Recipient's Users as part of the ATP Portal, in accordance with its Privacy Policy, available on the website: <a href="https://files.abergtelematics.com/PrivacyPolicy-pl.pdf">https://files.abergtelematics.com/PrivacyPolicy-pl.pdf</a>. Data subjects have the right to access their data and the right to rectify, delete, limit processing, the right to transfer data, the right to object and the right to lodge a complaint with the competent supervisory authority in the field of personal data protection.
2.&nbsp;&nbsp;&nbsp;&nbsp; Each Party to this Agreement is a data controller within the meaning of Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC ("GDPR"), with regard to the personal data of individuals,&nbsp; indicated in the Subscription Plan, as persons representing the Party, contact persons or persons responsible for the implementation of individual tasks under the Agreement. These data are made available to the other Party to the following extent necessary to conclude and perform the Agreement, i.e.: name and surname, position, telephone number, e-mail address.
3.&nbsp;&nbsp;&nbsp;&nbsp; Each Party will process the data of the persons referred to in paragraph 2 above, on the basis of Article 6(1)(b) and (f) of the GDPR, for the purpose of performing the Agreement, as well as for the purposes of the legitimate interests of the controller, including, m.in, establishing, pursuing or defending against claims, transferring personal data within the group of enterprises for internal administrative purposes and ensuring network and information security.
4.&nbsp;&nbsp;&nbsp;&nbsp; Each Party undertakes to process data in accordance with the Agreement, GDPR and other generally applicable laws, including informing its representatives, proxies or employees about the disclosure of their data to the other Party, its purposes and grounds, as well as the rights of data subjects.

Any changes to the Subscription Plan require declarations of will of both Parties submitted in documentary form under pain of nullity.
